Well, any songs that the band created they, or their publishing company or anyone else to whome they may have assigned the rights, own or have a copyright in the original work. The predicament you describe appears to be a contractual licensing arrangement that the band has with the recording company.
Typically, these arrangemtns forbid the band or creator from licensing live performances to any other than the recording company or their assignees.
So even though a band may have legal ownership to their own tunes, or an enforceable copyright, separate licensing arrangements with outside entities will place varying degrees of restrictions on the distribution of those tunes, performed by the creating band or not.
